TENANCY AGREEMENT

1. Parties
This Agreement is entered into between:
[landlord_name] (the "Landlord"), of [landlord_address], holder of National ID No. [landlord_id_number], KRA PIN [landlord_kra_pin];
and
[tenant_name] (the "Tenant"), of [tenant_address], holder of National ID No. [tenant_id_number], KRA PIN [tenant_kra_pin].
2. The Premises
The Landlord lets and the Tenant takes the following premises (the "Premises"):

The Premises are let for residential use only. The Tenant must not sublet without the Landlord's prior written consent.
3. Term
The tenancy runs for 12 months, beginning [lease_start_date] and ending [lease_end_date].
At the end of the term the tenancy continues on a month-to-month basis on the same terms, with either party able to end it on 2 months' written notice, unless a renewal agreement is signed.
Where the Premises fall within the scope of the Rent Restrictions Act, that Act applies in addition to this Agreement and prevails in case of conflict.
4. Rent
Monthly rent is KES [rent_amount] (the "Rent"), payable in advance on or before the 5 of each month.
Payment is by M-Pesa to:

- Reference: the property address + the month being paid
The Landlord issues a written receipt for each payment.
5. Deposit
The Tenant pays a deposit of KES [deposit_amount] on or before the lease start date. The deposit is held as security against unpaid rent, damage beyond fair wear and tear, and utility bills outstanding at end of tenancy.
The deposit is refundable within 30 days of vacant possession, less any sums lawfully deducted. The Landlord provides an itemised written statement of any deductions.
6. Utilities + service charges
The Tenant is responsible for:
- Electricity (KPLC token), water (Nairobi Water or county supplier), internet, gas, garbage — all metered or billed to the Premises.
- Any service charge separately stated below: [service_charge].
The Landlord is responsible for the structural insurance and any county rates on the Premises.
7. Repairs + maintenance
Landlord obligations: structural repairs (roof, foundation, walls), main plumbing + electrical, persistent issues with hot water + sanitation. The Landlord attends within 3 working days of written notification.
Tenant obligations: light bulbs + tap washers + general day-to-day upkeep, internal cleanliness, garden maintenance where the Premises includes a garden, and reporting any defect promptly.
The Tenant must not make structural alterations or paint without written consent.
8. Inspections + access
The Landlord may inspect the Premises during reasonable hours on 2 working days' written notice, save in an emergency.
9. House rules
- No pets allowed without written consent of the Landlord.
- Overnight guests for more than 7 consecutive days require written notice to the Landlord.
- No loud music or noise after 10pm on weekdays, midnight at weekends.
10. Termination + notice
Either party may end the tenancy by giving 2 months' written notice, expiring at the end of a rental month. The Tenant must hand back the Premises in the condition received, fair wear and tear excepted, with all keys returned.
The Landlord may terminate immediately for material breach (e.g. unpaid rent beyond 14 days after written demand, or unlawful use of the Premises).
11. Inventory
The parties agree the attached inventory (Schedule A), to be signed at handover, is the complete and accurate description of the condition + contents of the Premises at the start of the tenancy.
12. Dispute resolution
The parties agree to first attempt resolution by good-faith negotiation. Failing that, the dispute is referred to the Rent Restrictions Tribunal where the Premises fall within its jurisdiction, otherwise to the courts of Kenya.
13. Governing law
This Agreement is governed by, and construed in accordance with, the laws of Kenya.
